Answering my question of a few days ago, according to reader Nic Wolff:

According to 10 U.S.C. 113(a), a person must have been a civilian for ten years to be eligible for appointment as Secretary of Defense or to other top Defense Department posts - so, Bush had to find some other place for Powell.

Thanks for that important bit of legal trivia.
